1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of Aetherborne ("the Game"), including the website at aetherborne.gg, the web application at play.aetherborne.gg, and all related services (collectively, the "Service"), operated by Aetherborne ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
  • If you are under 18 (or the legal age of majority in your jurisdiction), you must have parental or guardian consent.
  • You are responsible for ensuring your use of the Service complies with all applicable local laws.

3. Account Registration

  • You must create an account to access game features. You may register using email/password, Google, or Discord authentication.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate, current, and complete information during registration.
  • Each person may maintain only one account. Creating multiple accounts to gain unfair advantages is prohibited.
  • You are responsible for all activity under your account.

4. In-Game Currency & Purchases

4.1 Virtual Currencies

The Game features virtual currencies:

  • Data Bits ($DB): Earned through gameplay (matches, quests, progression). Cannot be purchased with real money and have no real-world monetary value.
  • Quantum Credits ($QC): Purchased with real money through authorized payment providers. Used for premium purchases within the Game.

4.2 Purchases & Refunds

  • All purchases of Quantum Credits are final and non-refundable, except as required by applicable law.
  • Payments are processed by third-party payment providers (Paystack, PayPal). Their terms of service also apply.
  • We reserve the right to modify pricing, availability, and virtual item offerings at any time.

4.3 No Ownership of Virtual Items

Virtual currencies, cards, items, and other in-game assets are licensed to you, not sold. You do not own any virtual items. We reserve the right to modify, remove, or adjust virtual items for game balance and operational reasons.

5. NFT & Blockchain Features

  • The Game offers optional NFT export functionality on the Polygon blockchain.
  • Exporting a card as an NFT requires using a Neural Decoupler and linking a compatible wallet.
  • Blockchain transactions are irreversible. We are not responsible for transactions sent to incorrect wallet addresses.
  • NFTs represent in-game card data and do not constitute securities, financial instruments, or investments.
  • You are responsible for all gas fees and blockchain transaction costs.
  • We do not guarantee the value, liquidity, or marketability of any NFT.
  • Blockchain features may be modified or discontinued at our discretion.

6. The Exchange (Marketplace)

  • The Exchange is a peer-to-peer marketplace for trading decoupled cards using Quantum Credits ($QC).
  • A 10% transaction fee is applied to all sales on the Exchange.
  • Only decoupled cards (cards that have been freed from Bio-Lock using a Neural Decoupler) may be listed.
  • We are not a party to transactions between players. We facilitate the exchange but do not guarantee any trade.
  • We reserve the right to remove listings or suspend Exchange access for violations of these Terms.

7. Acceptable Use

You agree NOT to:

  • Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party tools.
  • Manipulate game mechanics, matchmaking, or leaderboards.
  • Engage in real-money trading (RMT) of in-game items outside the official Exchange.
  • Harass, threaten, or abuse other players.
  • Impersonate other players or Aetherborne staff.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Use the Service for any unlawful purpose.
  • Reverse-engineer, decompile, or disassemble any portion of the Service.
  • Interfere with the operation of the Service or servers.

8. Intellectual Property

All content, including but not limited to game assets, artwork, logos, character designs, card designs, music, text, code, and the Aetherborne name and branding, are the property of Aetherborne and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Account Suspension & Termination

  • We may suspend or terminate your account at our discretion for violations of these Terms, cheating, fraud, or any conduct harmful to the Service or community.
  • Upon termination, your license to use the Service ceases immediately.
  • We are not obligated to refund any purchases upon account termination due to violations.
  • You may delete your account at any time by contacting us.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHERBORNE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF VIRTUAL ITEMS, OR LOSS OF PROFITS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aetherborne, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through the courts of South Africa.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through in-game notifications or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
